Question: I am on a B-1 visa. I have a 10 year visit visa. Can I legally transfer my status to an EB-5 visa without leaving the US? I have the $500,000 needed for the EB-5 visa. How much time would this take?

Answer: It should be noted that B1/B2 visa, regardless how long the visa is valid for, is a non-immigrant visa. It does not allow the applicant to have a “dual intent”, namely a non-immigrant as well as an immigrant intent. Also it is a common misconception that a ten-year B1/B2 visa enables the applicant to stay in the US legally for 10 years. It does not. For each visit to the US on a B1/B2 visa, the permitted period of stay is usually 3-6 months, if not shorter. The current EB-5 processing time is more than a year. (14+ months). Obviously 6 months duration is not enough time to have your I-526 approved. While the EB-5 petition is pending, you can only enter the US on a B1/B2 visa with non-immigrant intent to stay temporarily rather than to reside in the US permanently. To adjust status on a B1/B2 visa upon the approval of EB-5 petition is a very risky approach absent of extraordinary circumstances (E.g. applicant unable to travel due to health and/or humanitarian reasons, etc.)
