美国东部时间上午十点EB-5听证会按时举行,小编除了再一次证实今年新法案要通过难上加难以外,也成为了纽约议员舒默的迷妹。短短五分钟的陈述,言简意赅,切中要害。吵来吵去,吵了一年多了,美国政治还真不是纸牌屋,一些小内幕听了以后也让人忍俊不禁。比如这次听证会的标题:The Distortion of EB-5 Targeted Employment Areas: Time to end abuse,个人认为用词过于极端和夸张。舒默议员在其陈述中清晰的说明了真正立法改革的目的以及现在的困局,大家来听一下吧。(节选舒默陈述全文,英文见后,如有部分差错为人为纪录问题,不影响释义,请提出指正,多多包涵。)



 

谢谢主席,我首先要感谢所有的议会成员举办这一场听证会,感谢你们为通过EB-5项目作出的努力。众所周知,我个人参与项目改革多年,回溯到综合移民改革。在该法案中,综合移民改革对于EB-5是十分严肃的。我们最后将问题归结为不良运作和提高投资金额。从最早开始,我一直支持改革,事实上Grassley议员在草案中提出的所有改革条款,我相信在座的每一位议员都会同意,包括议员Corner 和议员Tills,这不是问题。也许有的人会说“噢,也许不需要改革吧。”但是改革是必要的。事实上,我们现在就可以通过一些改革条款, FLake议员提议了一份草案,该草案中我,Corner议员和Tills议员都有参与,现在就可以确定法案中一部分的条款。我们都很支持,在议会中也会像刀切黄油一样容易通过。即使,我们不能够在某些事情上达成共识,我们仍然应该通过法案。我们不可以因为一个“钱到底该去哪儿”的问题上纠缠不清,而导致新法案的推进停滞不前。


所以,话题是目标就业区。我们希望可以达成共识,但是不能,原因也不是因为我们尝试的不够多。我想Corner议员和我对于这个联盟付出了巨大的努力,同时,我们都很清楚偏僻地区需要帮助。但是,请记住,偏僻地区并不意味着贫困地区,在偏僻地区的奢华滑雪度假村不属于贫困的范畴。所以,如果我们关心贫困地区,就应该一视同仁。

 

你知道我想帮助偏僻地区,纽约州农村人口数量全美排名第三。我们应该公平的处理,在大城市内工作的人并非居住在项目旁边。我不同意刚才听证员的发言称“噢,我们只在贫困人口居住的区域开发项目”,那是不可能的。城市的建设不是按照这样的规律,城市地区难道没有为贫困人口提供工作机会吗?


我希望大家再来看我们之前所展示的地图,在纽约市,这是曼哈顿下东区的人口普查区,项目在这里,所属于的人口普查区在这一块区域。你认为在项目里施工的工人们均来自这一块人口普查区吗?那大家想想南布朗克斯区,作为最贫困的国会选区,生活在这里的人们都不在这片人口普查区域工作,他们搭乘地铁到办公大楼里共工作,无论是清洁工作、餐厅服务工作或行政工作。中产阶级的人都在哪里获得工作机会?相同的道理,所有的办公大楼就是我们的工厂。正如我们不认为爱荷华州最贫困的地方应获得EB-5资金、只要最贫困的人得到帮助所有生活在爱荷华的人都可以使用EB-5资金。相同的规则应适用于城市区域,并且不仅仅是纽约市,还有布法罗、罗切斯特、雪城等非发达城市,都受益于EB-5获得更好的发展。 


因此,我们必须互相做出妥协,但是我们中的有些同事不愿意做出妥协。有些议员甚至愿意为偏远地区提供特属解决方案,但是偏远地区的经济实力是远远不能够和城市地区匹敌的。我们愿意做一些事情让这些偏远地区得到发展,我们愿意做Sanyar议员草案中提到的事情。我理解城市区域的再发展也是非常困难的,偏远地区应该有新的项目被开发。人口普查员之前所做的工作非常好。有些人认为,工人所居住的人口普查区与所工作的人口普查区不是同一个区域,所以不能为该居住人口地区创造足够多的就业机会,所以这不是一个好的项目。这种观点是不利于穷困地区发展的。这是一个论点,一个只想让全部资金去到国家特定某个区域,而不是让资金流入到全国各个地区的论点。我不会再说其他的事情,因为我们又会回到我们上次争论的地方。我想说,我们的时间十分有限,我们需要做出妥协,我们不能什么都想要,我们不能再让法案维持现状,法案需要变革。我想说的最后一件事情,就是我亲爱的朋友Grassley议员,请相信,我们一定可以完成这次变革!让我们试试做出妥协,交出一份让每一个人都开心的答卷,没有人可以什么都得到,我们需要做出一些让我们所有人都骄傲的事情。这就是我今天的发言。

 Thank you, Mr.Chairman, I wanna thank for the ranking members to hold the hearing, thank youfor the efforts to approve EB-5. As everyone knows, I have been working onreforming the program for years, dating back to comprehensive immigrationreform. In that bill, the comprehensive immigration reform was very serious onEB-5. We crack down on bad actors and increasing the investment threshold. Thistime around from day one, ive been for reform, and in the fact, all of thereform measures that Senator Grassley put in this bill, I think senate Corner ,all of those who all of us want to do those reform. That's not the issue here.And it is a strongman to say ‘Oh there shouldn’t be a reform”.Reform has tohappen, and in fact we could pass that reform measures now, because senateflake has introduced the bill, which im on the bill, so is senate corner and sois Senate Tills to get the reform part done right now. We are all for it, andit will sell, it go through the senate like a knife through the butter. If wecan’t get an agreement on the other stuff, we should do that anyway. Weshouldn’t let a reform be held hostage to a dispute over where the money shouldgo.


That’s the issue:Targeted Employment Areas. Ok? And we try to come up with an agreement, and wecouldn’t, but not for lack of trying. I think Senate Corner and I who work veryhard on this allies are very aware that the rural area need help. Althoughremember, no poverty in the rural areas, fancy ski resorts not included in yourchanges, fancy resorts in some rural areas not included in changes. So if weare caring about poverty here, which I do, what is good for the goose is goodfor the gander. 


And to say, youknow I want to help rural area, while New York the 3rd largest ruralpopulation. We gotta do it in a fair way. The other program sell the poorpeople, and because of the inomineble cities, people don’t live right next doorto the project. The choice was them, I would disagree with one of thewitnesses, who said oh we want to put the project only in poor people areas,that won’t happen. Its not how city are structured. So the no jobs for poorpeople in urban areas or making some changes that make sense.


In new York city,I wish we had the map that we used early on, …. Ok he showed a cesus track onlower eastside of Manhattan, the building is here, and the cesus track isthere. Yea, what you think the workers in the building, the very people at thecensus track works in that building, what you think the people in south Bronx, the poorest congressionaldistrict in the country work. They don’t work in their district, in that censustrack, they get on the subway, and they go to an office tower, and they eitherclean it or service food or do administrative work. Where did the middle classpeople get jobs? Same thing, all office towers are our factories. And just as we don’t say that the poorest part of Iowa should get EB-5, everybody in Iowa should get EB-5 as long as poor people are helped, We should do that for oururban areas. And its not only  new Yorkcity, we have the Buffalo, or Rochester or Syracuse, hardly the booming areas.They are doing better, thank god.


So we have tohave a compromise, and that I have to say some of my colleagues are not willingto compromise, some were. Senator….. even offered a rural settiside, but thatnot even work with the reason that the rural area can not compete with thewealthy urban areas. We are willing to settiside so rural areas get something,we are willing to do the same thing for Senator Sanyar’s provision. thingsshould to be build in the areas, I understand urban redevelopments are  hard. CRA did a good job in that. Or, Theidea that because you don’t live in the same census track at the joining censustrack, the project is no good, its not gonna help the poor is bangk, its anargument, it's a self- served argument to see all of money goes to some partsof the country, not the others. I won't say anything, and we will back at wherewe were last time. And what I about to say and my time is going to expire, is Iwant to compromise, we don’t have to get everything, and we don't have to keepthe way as  it is and we certainly need areform. My last thing that I would like to do is that to say to my dear friendSenator Grassley, is the beatles, WE CAN WORK IT OUT !!! So lets try to workout a compromise that can make everyone happy , that nobody gets everything,and  we get something done that we canall be proud of. That’s the pintch that I wanted to make today.
