国家税务总局近期发布了关于“完善关联申报和同期资料管理”的42号公告。随着BEPS（“税基侵蚀与利润转移”）行动计划已逐步在中国落地，42号公告要求下的转让定价本地/主体文档以及关联业务往来报告表的准备也已经或正将全面启动。面对全新的合规要求，纳税人在准备过程中将碰到哪些具体问题？应当如何准备并制定策略迎接其变化？

The State Administration of Tax recently issued Public Notice No.42 to regulate the administration of related party transaction reporting and transfer pricing documentation.  In the context of recent Chinese implementation of the final reports on Base Erosion and Profit Shifting (“BEPS”) Action Plans, the requirement for local file/master file of TPDs and the related party transaction reports under Public Notice No.42 have already been or will be launched.  Considering the new compliance requirement, we will talk about what kind of issues the taxpayers may encounter and the suggested actions to face the changes.

In early 2017, a notice was issued by the State Administration of Foreign Exchange on Further Deepening the Reform of Foreign Exchange (Forex) Administration and Improving the Review for Authenticity and Compliance, which makes specific requirement on  eligible scope of foreign exchange settlement, foreign exchange administration and investment, etc.  We will talk about the impact and challenges this regulation may bring to enterprises regarding cross-border charges and outbound investment.
