【485签证】满两年学时后可直接申请工作签(PSW)要求详解,澳洲留学那些事儿微信公众号文章

最近有很多同学咨询485签证两年的学习要求，特别是一年半的Master+半年的Graduate Diploma是否满足两年Australian Study Requirement的要求，在此Joy Midheaven特别为大家说明一下：

485TR签证现在分为两个Stream:

-Post-study Work stream :就是最新的工作签证，也就是2011年11月5号之后首次申请澳洲学生签证的同学申请的工作签

-Graduate Work stream: 也就是之前的TR，即移民专业SOL 1专业的毕业生申请的Stream

这两个Stream最大的不同在于：PSW不分专业，至少本科以上学历，读满两年，雅思四个六可以申请；原本的Graduate Work stream要求和原来一样，必须是SOL1移民专业，degree, diploma and trade qualification，读满两年，雅思至少四个六，必须要递交职业评估。

大家最关心的也是最confuse的就是两者对于学历的要求，现在为大家说明一下：

根据移民法条例，移民专业Graduate Work Stream, 完成1.5年Master+半年Graduate Diploma可以申请（满足eligible qualification要求）；Post-study Work Stream, 读完1.5年Master+半年GraduateDiploma不可以申请，因为不满足eligible qualification要求；但是，如果是先读的graduate diploma,之后接着读1.5年的研究生，则满足要求可以申请PSW visa, 因为GD课程是和之后所读的Master课程的相关连接课程。

下面附上具体说明请大家参考：

4 Study must have resulted in a degree, diploma or tradequalification

4.1 What is adegree, diploma or trade qualification

Only study that has resulted incompletion of a degree, diploma or trade qualification can be counted towardsmeeting the Australian study requirement.

In regulation 1.15F, degree,diploma and trade qualification have the meaninggiven in regulation 2.26AC(6) - see regulation 1.15F(2). Note in particular that degree includes a bachelor and anyhigher degree and diploma includes associate and advanced diplomas.

This means a visa applicant who hascompleted in Australia:

• a CertificateII in any discipline or

• a CertificateIV in a discipline other than a trade, for example a Certificate IV in BusinessManagement or

• a GraduateCertificate

cannot use that study to meet theAustralian study requirement (The list above is illustrative, not exhaustive.)However, if an applicant:

• completes aCertificate IV (where the study met the requirements in regulation 1.15F) and

• was grantedcredit for some of the completed units of the Certificate IV course in asubsequent degree or a diploma which they have completed

those credits can be used tomeet the Australian study requirement:

• the time takento study the units of the Certificate IV course can be counted towards theregulation 1.15F(1)(b) 16 month requirement, however

• only thecredited units from the degree or diploma can be counted towards meeting the 2academic years study requirement.

This means that the study can onlybe counted once; it cannot be used towards the Certificate IV and then againtowards the degree or diploma.

If an applicant:

• nominates anon-trade occupation

• completes adiploma or a degree

• thenundertakes a trade qualification (such as a Certificate III or IV)

neither the trade qualification nor theperiod of the trade qualification study can be counted for the purpose of theAustralian study requirement. This could mean that the applicant does not meetthe Australian study requirement within the required 6 months before lodgingtheir visa application, due to the time taken to complete the tradequalification (or any other qualification that cannot be used to meet theAustralian study requirement because the study did not meet the requirements inregulation 1.15F and result in the award of a degree, diploma or tradequalification).

Note: There are two streams for theVC-485 visa:

• the Post-Study Work stream and

• the Graduate Work stream.

The two streams have different requirementsin relation to eligible qualification.

Post-Study Work stream

Eligible qualifications for the Post-Study Work stream include:

• an AustralianBachelor Degree (including Honours)

• a Masters byCoursework Degree

• a MastersExtended Degree

• a Masters byResearch Degree or

• a DoctoralDegree.

Nested courses, or courses thatarticulate into an eligible qualification, are accepted for the Post-Study Work stream if the study that contributes tothe completion of an eligible qualification has been undertaken at the AQFlevel 7 or above.

For example, applicants whoundertake a Graduate Certificate or Graduate Diploma course which articulatesinto, or is nested in, a Bachelor or Masters Degree, are eligible for the Post-Study Work stream, provided they ultimately completean eligible qualification.

Graduate Work stream

Eligible qualifications for the Graduate Work stream include a:

• degree

• diploma and

• tradequalification.
