美国的电视节目改编的刑事调查利用专门的技术手段和罪犯供词,以警方解决犯罪案件而结局。事实上,严重罪行的刑事调查可能需要数月甚至数年的时间,有时候仍没能解决。嫌疑犯即使面对强有力的证据,保持沉默的宪法权利,也是美国司法制度的支柱之一。当嫌疑犯援引其保持沉默的权利时,美国如何调查高调和严重的犯罪?为什么有些案件需要几个月甚至几年的时间来调查或起诉,即使警方已经确定了嫌疑犯?美国司法部驻华法律顾问胡倚婷,耶鲁法学院Paul Tsai中国中心法律高级研究员Jeremy Daum,将讨论美国的刑事调查过程,并为观众强调几个案例。发言中胡女士和Daum先生将重点关注美国宪法,成文法和判例法,作为确保嫌犯和被害人依法享有保护权利的指导原则。


This program will be conducted in English.

 

American television shows dramatize criminal investigations with using specialized techniques and tools and confessions of criminals, and the television show ending with the police solving the crime.  In reality, criminal investigations of serious crimes may take many months and even years, and sometimes are unsolved.  The Constitutional right of suspects to remain silent, even when confronted with strong evidence against them, is one of the pillars of the American justice system.  How are high profile and serious crimes investigated in the United States when a suspect invokes their right to remain silent?  Why do some cases take months or years to investigate or prosecute years even when the police have identified the suspect?  Ye-Ting Woo, the U.S. Department of Justice Resident Legal Advisor at the Embassy, and Jeremy Daum, a Senior Research Scholar in Law and Senior Fellow at the Paul Tsai China Center, Yale Law School, will speak about process of criminal investigations in the United States, highlighting several case examples for the audience.  In their remarks, Ms. Woo and Mr. Daum will focus  on the U.S. Constitution, statutory laws and case law as guiding principles for ensuring that the rights of suspects and crime victims are afforded protections under the law.

The program will start at 6:30pm and doors will open at 6pm. Please try to arrive at least 10 minutes before the program starts to allow enough time to go through security.

Directions: Metro Line 10, Liangmaqiao Station Exit B, walk northeast to the Tian Ze Road intersection of An Jia Lou Road, north side of the Visas Office.
