What is a ComplyingDevelopment Certificate (CDC)?

什么是CDC?



在日常工作中,我经常用到CDC的概念,CDCCheckList,以至于我的册子的某几页已经断落掉。

什么是CDC?

这个可不是我们平日里看到的公交车上亮着的CDC灯哦。

这个是俗称的快速审批,我们主要用作于绝大部分的推倒重建,以及相当一些新开发区的申报审批。比如我们在未来的一段时间里,对于南区的部分政府,将主要用CDC的设计要求去安排工作。

以下是关于CDC的解释:

A Complying Development Certificate (CDC) combines thefunctions of both development consent and a construction certificate. It is a form of approval appropriate for manytypes of minor or routine development, which have a minor impact but have notbeen specifically declared as exempt development under the provisions of StateEnvironmental Planning Policy (Exempt and Complying Development Codes) 2008,State Environmental Planning Policy (Affordable Rental Housing) 2009, StateEnvironmental Planning Policy (Infrastructure) 2007.

Complying development is certified under a separate processto a development consent and construction certificate. Complying development approvals are limitedto certain locations and must be carried out in accordance with pre-determinedstandards and conditions. You will stillneed to appoint a Principal Certifying Authority (PCA) to monitor the worksduring construction.

Council or a Private Accredited Certifier can grant aComplying Development Certificate (and act for you in this regard). Thecertifier that you select is referred to as the Principal Certifying Authority(PCA).

The information that you will need to submit includes thefollowing:

  • explanation of the work proposed;

  • plans detailing the work proposed (including asite plan, elevations, floor plans, parking arrangements, loading facilities,ground levels to be modified and drainage information);

  • specifications for the work proposed;

  • demolition plan (where necessary);

  • existing and proposed fire safety measures (forthe change of use of a commercial building);

A Complying Development Certificate can only be issued if:

the proposed development fully complies with the specificrequirements and criteria for Complying Development outlined in StateEnvironmental Planning Policy (Exempt and Complying Development Codes) 2008,State Environmental Planning Policy (Affordable Rental Housing) 2009, StateEnvironmental Planning Policy (Infrastructure) 2007.

the proposal complies with the BCA and the EnvironmentalPlanning & Assessment Act 1979If the specified criteria in the ComplyingDevelopment Codes or the GPSO cannot be satisfied, then a DevelopmentApplication must be submitted to Council, and a Construction Certificate mustalso be obtained, before commencing any work.

Neighbour Consultation for Complying Development

If you are planning to:

  • build a new single or two storey home

  • add a single or two storey addition to anexisting home, or

  • demolish an existing building

and the proposal meets specific criteria and standards, thenyour application can be complying development. This means that you can expect a determination from your council or aprivate certifier in around three weeks. Building works inevitably may cause disruption but talking through yourdesigns and likely timeframe with neighbours will help address concerns andavoid disputes when building begins.

This early consultation will help them understand your plansand the likely impact on their own properties. This timely consultation alsoallows you to easily respond to questions before any detailed plans arefinalised.

WHEN DO YOU NEED TO CONSULT WITH YOUR NEIGHBOURS?

There are two requirements for informing neighbours who livewithin 20 metres of your property about the proposed building works:

1.The council or certifier must advise the neighbours 14days before the application is approved if the property is in an existingneighbourhood.

2. You must advise your neighbours seven days before thework starts. If the development is in a new residential release area neighboursmust be advised at least two days before work starts.

While your neighbours are not able to insist on changes tothe development plans, giving them an opportunity to review the proposal canhelp address any issues. The earlier this takes place in the process, thebetter for everyone concerned.

HOW SHOULD YOU CONSULT WITH YOUR NEIGHBOURS?

Drop copies of the proposed plans, including a relevantexplanation, into letterboxes. Ring your neighbours to let them know whatyou’re planning and talk through any concerns.

Invite your neighbours to an informal meeting, so you canclearly explain the building works and answer any questions. Talk through the likely length of thebuilding works, noise levels and any access or rubbish removal issues.
