期房买家将更有保障,日落条款已修订Sunset Clause Amendment will protect purchasers

什么是“日落条款”?

如果开发商没能按期交房,他们需要把定金退回,现在某些开放商利用了这一条款,故意拖慢工期进度,并以此为由退还预购者的定金,再把房屋重新以高价售卖,但有时很难去界定这究竟是不是开发商蓄意而为。

What is a Sunset Clause?

The Sunset Clause is the statement in the Contract Of Sale that refers to the maximum time in which the developer has to finish the project. This time varies across developments, depending on the size of the property. If your property is not finished by this time, you are legally entitled to walk away from your contract and receive your deposit back in full.


为了保护消费者的权益,新州创新及政策改善部长Victor Dominello 专门召集了各个领域的房产专家们一起开会商讨,这些专家分别来自澳大利亚城市发展研究所(UDIA),澳大利亚房产委员会,澳大利亚银行家协会,房产业主协会,新州法律协会(房产法委员会),澳大利亚Conveyancers 研究院新州分院,新州房地产协会,和房地产经纪人协会, 制定了一个应急解决措施。这一措施规定:现在开发商要解除和购买者的合同只能在规定的地方,并且做出合理的解释,如果购房者不接受开发商给出的解释,可以起诉开发商,一切费用由开发商承担。“任何怀着不道德想法的开发商都应该知道,他们的行为将不再得到容忍,”Victor Dominello 说。

The Amendment will protect purchasers by only allowing developers to rescind a contract when the sunset date is reached and requires the Supreme Court to review the circumstances to make sure the rescission is just and equitable.

None of the amendments that have been placed into this Bill reduce or change the rights of the purchaser to activate the sunset cluase on their own behalf, only the rights of the vendor. This amendment should actually give the purchasers some greater comfort around purchasing off-the-plan.
